1. Acceptance of These Terms

By accessing or using Ekotriyo.com ("Site"), purchasing any product or service (collectively, "Services"), or clicking “I agree,” you ("User") confirm that you have read, understood, and accept these Terms & Conditions ("Terms"). If you do not agree, please refrain from using the Site.

2. Definitions

• Company / We / Us / Our: Ekotriyo.com, a business registered in Bangladesh.

• User / You: Any natural or legal person who accesses, browses, registers, or transacts on the Site.

• Digital Business Identity (DBID): The unique identifier issued by the Ministry of Commerce for digital businesses under the forthcoming Digital Commerce Act 2023.

• Applicable Law: Consumer Rights Protection Act 2009, Digital Security Act 2018, Information & Communication Technology (ICT) Act 2006, Digital Commerce Policy 2020, Digital Commerce Operational Guidelines 2021, and any subsequent rules or regulations.

3. Eligibility & Account Registration

Users must be at least 18 years old and capable of entering into binding contracts under Applicable Law. When creating an account, you agree to provide accurate, current, and complete information and to keep such information updated.

4. Products & Service Information

We strive to display products accurately; however, minor variations (e.g., colour or packaging) may occur. All product availability, descriptions, and prices are subject to change at any time without notice.

5. Pricing, Taxes & Payment

All prices are listed in Bangladeshi Taka (BDT) and inclusive of VAT where applicable. We accept payments through authorised gateways compliant with Bangladesh Bank circulars on digital payments. Refunds will be processed within 3 (three) working days of cancellation, per Bangladesh Bank quick‑refund guidelines (BB Circular PSD 09/2023).

6. Order Processing, Shipping & Delivery

Orders are processed upon successful payment confirmation. Estimated delivery timelines are displayed at checkout. Title and risk pass to the User upon delivery. Delivery delays caused by force majeure events are not our liability.

7. Returns, Refunds & Replacements

A User may request a return or replacement within 7 (seven) days of delivery if the item is defective, damaged, or not as described. To initiate, email support@ekotriyo.com with order details and evidence. Approved refunds are issued to the original payment method within the timeframe in Clause 5. 

8. User Responsibilities & Prohibited Conduct

Users agree not to:

1. Violate any Applicable Law or third‑party rights;

2. Upload viruses, malware, or harmful code;

3. Resell, redistribute, or exploit any content without permission;

4. Use the Site for fraudulent, obscene, or defamatory purposes.

9. Intellectual Property

All trademarks, trade names, logos, text, graphics, and code on the Site are owned or licensed by Ekotriyo.com. Users may not copy, reproduce, or distribute materials without prior written consent.

10. Data Privacy & Security

We process personal data in accordance with our Privacy Policy and the Digital Security Act 2018. We employ industry‑standard encryption and follow Bangladesh Bank guidance on data security for digital commerce.

11. Third‑Party Links

The Site may contain links to external websites. We do not endorse and are not responsible for their content or practices.

12. Limitation of Liability

To the fullest extent permitted by law, Ekotriyo.com shall not be liable for indirect, incidental, or consequential damages arising from your use of the Site, including but not limited to lost profits, data, or goodwill.

13. Indemnification

You agree to indemnify and hold harmless Ekotriyo.com, its directors, employees, and affiliates from any claim or demand arising out of your breach of these Terms or violation of any law or rights of a third party.

14. Governing Law & Jurisdiction

These Terms are governed by the laws of Bangladesh. Any dispute shall be resolved exclusively by the courts of Dhaka, Bangladesh.

15. Dispute Resolution & Arbitration

Prior to litigation, parties shall attempt to resolve disputes amicably within 30 days. Failing amicable resolution, disputes may be submitted to arbitration under the Arbitration Act 2001 (Bangladesh), seat in Dhaka, language English.

16. Modification of Terms

We may amend these Terms from time to time. Material changes will be posted on this page with a new “Effective Date.” Continued use constitutes acceptance.

17. Severability

If any provision is held invalid, the remaining provisions will remain in full force.
